Reasons for Exemption
The State CEQA Guidelines provide a series of Categorical Exemptions for actions that have been deemed by the State Legislature to have minimal impacts on the environment. The proposed installation of the 5,000-gallon hydropneumatic tank and supporting infrastructure at the existing Bear Valley Reservoir Site has been determined to have no potential to cause significant adverse effects on the environment and will provide the Department with a new pumping capability to protect the potable water distribution system into the future. Categorical Exemption Class 2 exempts “replacement or reconstruction of existing structures or facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, including but not limited to: (c) Replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.” The exceptions to the issuance of categorical exemptions have been evaluated for the proposed action and no significant impacts have been identified. The proposed installation and future operations and maintenance of the Knickerbocker Hydropneumatic Tank System Project has been determined not to have a potential to cause significant adverse environmental effects as a result of any of the exceptions. Therefore, the proposed action qualifies with the requirements for a Categorical Exemption, Class 2, under Section 15302 of the State CEQA Guidelines.
