Reasons for Exemption
As noted above, the Project consists of rehabilitating and maintaining the existing stormwater system in Sultana, along with expanding the system by adding approximately 1,500 feet of pipeline. As such, the Project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Class 3, Section 15303(d) New Construction or Conversion of Small Structures, whereas water main, sewage, electrical, gas, and other utility extensions, including street improvements, of reasonable length to serve such construction are exempt. In addition, the Project is exempt from the CEQA pursuant to Other Statutory Exemptions Section 15282(k) as the project consists of installation of a new pipeline, as set forth in Section 21020.21 of the PRC, as the pipeline is less than one mile in length [14 Cal. Code Regs., §15061, subd. (k)]. Therefore, use of CEQA Guidelines Section 15303(d) and Section 14 California Code Regulations Section 15282(k) are applicable and appropriate for this Project.
