Reasons for Exemption
The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA). Pursuant to CEQA Guidelines Section 15061(b)(3) the project is complying with intended uses and development patterns in the greater Civic Center Campus area. As such, it can be seen with certainty that there is no possibility that the development in question may have a significant effect on the environment. The proposed project is also categorically exempt from the provisions of CEQA pursuant to CEQA Guidelines Section 15304(b), Minor Alterations to Land, because the project consists of a minor private alteration of land which does not involve removal of healthy, mature, scenic trees. Rather, the proposed development would install approximately 50 trees. The proposed development is further categorically exempt from the provisions of CEQA pursuant to CEQA Guidelines Section 15332, in that the proposed development is considered “In-Fill”. The proposed project will not require the use of utilities and public services beyond that of the ability of the City; the proposed project is consistent with the objectives, policies, general land uses and programs specified in the general plan and applicable specific plan; the proposed project occurs within City Limits on a project site of no more than five acres and is completely surrounded by urban uses; the project site has no value as habitat for endangered, rare, or threatened species and is mapped as “Urban” by the Eastern Contra Costa County Habitat Conservancy; and approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality.
