Reasons for Exemption
The project is to amend District Rule 2520 Federally Mandated Operating Permits to remove rule section 13.4 (Emergency Provisions) to align with EPA Title V regulation, and to revise definitions for consistency with the CM, federal regulations, and District Rule 2201 (New and Modified Stationary Source Rule). District staff concludes that there is substantial evidence in the whole record before the District that the proposed project would not cause any adverse impacts on the environment. The District finds that the project is categorically exempt from the provisions of CEQA pursuant to CEQA Guideline §15308 (Actions by Regulatory Agencies for Protection of Natural Resources), and finds that the project is exempt per the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment (CCR §15061 (b)(3)).
