Reasons for Exemption
The city has determined that, pursuant to CEQA Guidelines Section 15378, the administrative act of renewing a commercial cannabis permit is not a project subject to the California Environmental Quality Act (CEQA) because the act will not result in direct or indirect physical changes in the environment. The city previously determined that the commercial cannabis business is exempt from CEQA pursuant to Section 15301(Existing Facilities) of the CEQA Guidelines, as it involves use of an existing building with no expansion of floor area or increase in the use of resources, such as energy and water, above that already utilized by the existing facility and anticipated by the city’s General Plan; therefore, no further environmental review is required.
