Reasons for Exemption
Project is categorically exempt, consistent with the California Environmental Quality Act of 1970 (CEQA) and the State CEQA Guidelines, pursuant to Title 14, Cal. Code Regulations Section 15305 pertaining to Minor Alterations in Land Use Limitations. The use of Section 15305 is applicable and appropriate as the requested modification does not change the land use or density and the intent is to update the site plan because of the approval of Tentative Parcel Map No. PPM 23-027. In accordance with Section 18 of the Zoning Ordinance, the Resource Management Agency Director is authorized to approve minor modifications in the approved plan upon a request by the applicant, or their successors as long as said modifications do not materially affect the determination of the Planning Director. Therefore, the lead agency concludes that the proposed project fits under the exemption as the project is consistent with the Tulare County Zoning Ordinance and State CEQA Guidelines.
