Reasons for Exemption
This project is exempt under Section 15301/Class 1 of the California Environmental Quality Act (CEQA) Guidelines as follows:
Under Section 15301/Class 1, the proposed project is exempt from CEQA requirements when the project consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The key consideration is whether the project involves negligible or no expansion of use. Section 15301/Class 1 includes restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety, unless it is determined that the damage was substantial and resulted from an environmental hazard such as earthquake, landslide, or flood.
The project proposes the re-establishment of a vacant fuel station and convenience store. The primary structure suffered a fire in 2018 halting all operations. The owner proposes the restoration of the structure in addition to minor improvements to the structure and project site. The rehabilitation of the site will not expand the former use.
Therefore, the project is categorically exempt pursuant to Section 15301/Class 1.
