Reasons for Exemption
The adoption of the 2021-29 Housing Element is exempt from CEQA requirements per Section 15061 of the CEQA Guidelines (14 Cal. Code Regs. Section 15000, et seq.). Specifically, Section 15061(b)(3) states, in part, that a project is exempt from CEQA if "the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA." The 2021-2029 Housing Element would not result in any direct or indirect physical changes to the environment. The Housing Element Update is strictly a policy document and does not provide entitlements to any specific land use projects. None of these changes have the potential to adversely affect the physical environment, as they merely require adherence to slate law requirements necessary to bring the Housing Element to conformance to state law.
