Reasons for Exemption
The project is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15303 (Class 3-New Construction of Small Structures), which covers the construction of small new structures, including multi-family structures with no more than four dwelling units on one legal parcel. The proposed project is also exempt from the provisions of CEQA pursuant to CEQA Guidelines Section 15332 (Class 32 - Infill Development Projects). Specifically, the project meets the requirements of CEQA Guidelines Section 15332 in that it is (a) consistent with the General Plan designation and applicable zoning designation and regulations, (b) occurs within the city limits on a site less than five acres that is substantially surrounded by urban uses, (c) has no value as habitat for endangered, rare, or threatened species, (d) would not result in significant effects relating to traffic, noise, air quality, or water quality, and, (e) can be adequately served by all utilities. The project is not subject to any of the exceptions to a categorical exemption, as set forth in CEQA Guidelines Section 15300.2.
