Reasons for Exemption
The project consists of the installation of new panel antennas and remote radio units to an existing cellular communications tower and installation of the associated equipment and infrastructure as described above. Class 1 exemptions consist of the minor alteration of existing public or private structures, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The project as proposed is consistent with the exemption class description noted above and is exempt pursuant to Class 1 of the CEQA Guidelines. The modification and operation of an existing cellular communications tower at an existing community park is consistent with the exemption class descriptions noted above and is exempt pursuant to Class 1 of the CEQA Guidelines. The project will result in emissions of radio frequency electromagnetic radiation (RF). The applicant provided an analysis of the risk from such radiation (Radio Frequency Safety Predictive Report by Waterford Consultants, LLC, dated August 19, 2022). The conclusion of the study was that the proposed wireless communications tower and associated equipment would comply with the FCC’s current prevailing standard for limiting human exposure to RF energy. Due to the mounting method utilized, the general public would not normally be able to approach the antennas. Therefore, no significant impact on the general public is expected. The calculated electromagnetic field strength level in publicly accessible areas is less than the existing standard allows for exposure of unlimited duration. Based on worst-case predictive modeling, there are no modeled areas on any accessible ground-level walking/working surface related to the proposed Dish antennas that exceed the FCC’s occupational or general public exposure limits at this site. The public exposure limit is based on a standard published by the American National Standards Institute (ANSI) and the Institute of Electrical and Electronics Engineers (IEEE). The Federal Communications Commission (FCC) has adopted these exposure limits as standards and is the agency charged with their regulation and enforcement.
