Reasons for Exemption
As approved on May 21, 2024, the District’s action is not a CEQA “project” because it does not commit the District to any activity having the “potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment” per State CEQA Guidelines section 15378. The CMAR Contract only authorizes the collection and coordination of information for the PWS Operations and Education renovation project. Therefore, the CMAR Contract does not have the potential to directly or indirectly cause a physical change in the environment. In the alternative, the CMAR Contract is exempt from CEQA pursuant to State CEQA Guidelines section 15061(b)(2), the common-sense exemption from CEQA for those projects for which it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Again, the CMAR Contract strictly involves the collection and coordination of information. Thus, it can be seen with certainty that this activity will not have any significant effect on the environment.
