Reasons for Exemption
The project is exempt pursuant to California Environmental Quality Act (CEQA) Guideline § 15182. The City reviewed the environmental impacts of the proposed property acquisition pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq. "CEQA") and the regulations promulgated thereunder (14 Cal. Code of Regs.§§ 15000, et seq., the "CEQA Guidelines"). CEQA Guideline§ 15182 provides that where a public agency has prepared an BIR on a specific plan after January 1, 1980, a residential or mixed-use project in conformity to that specific plan is exempt from CEQA if the project meets the requirements of Section 15182 subdivisions (c). On November 20, 2018, City Council approved the Beach Boulevard Specific Plan (BBSP) and certified the Final Environmental Impact Report No. 2017-00350 (EIR No. 350), which included the Property within the boundaries of the BBSP; and the Proposed Project would be a residential project consistent with the provisions BBSP. Accordingly, this activity is not subject to further environmental review.
