The Lease agreement between the County of San Diego and the Sheriff’s Department is categorically exempt from CEQA pursuant to Section 15301: Existing Facilities as it involves amending an existing lease to allow for County to sublease or license existing communications equipment on an existing tower to be used for both public safety and education purposes instead of public safety only. Additionally, the lease amendment will not extend the lease term, does not involve any improvements, and will allow for the continuation of an existing use of an existing facility that would have no permanent effects on the environment and does not involve the expansion or change of the existing use. Further, no exceptions listed in CEQA Guidelines Section 15300.2 apply to the project.
