Document Description
The project site is located northwest of the community of Tipton and is not within an Urban Area Boundary (UAB) or an Urban Developed Boundary (UDB). The property is zoned AE-40 (Exclusive Agricultural - 40 Acre Minimum). The property owner is requesting an administrative variance for construction of a new (replacement) well to supply the property with water for the dairy uses consistent with the existing zoning. The location of the new well is unable to comply with the minimum setback requirements from the animal corrals. The contractor will install a I 00' annular seal to eliminate the risk of contamination to the new well site location. The beneficiary of the project is the applicant.

Reasons for Exemption
This action is consistent with Section 15303 Class 3, New Construction or Conversion of Small Structures; in this instance, the new structure will provide water for the dairy in the AE-40 (Exclusive Agriculture - 40 Acre Minimum) zoned property. Also, construction of a well is subject to Tulare County Ordinance Code Part IV. Health, Safety and Sanitation Chapter 13, Construction of Wells. Therefore, the application of CEQA Section 15303 is applicable and appropriate for this project.
