Reasons for Exemption
On April 16, 2024, the City Council adopted Resolution Nos. R-2024-18, R-2024-21, R-2024-22 approving updated Development Impact Fees. City Council found that adoption of theses Resolutions is exempt from the California Environmental Quality Act because the adoption of these Resolutions is not a project, in that it is a government funding mechanism which does not involve any commitment to any specific project (CEQA Guidelines Section 15378(b)(4)), and because it can be seen with certainty that there is no possibility that the fees may have a significant effect on the environment, in that these Resolutions contain no provisions modifying physical design, development, or construction of residential, commercial or industrial development or the construction of any development project. This exemption is based on CEQA Guidelines Section 15061 (b)(3), 15378(b)(4), and 15273.
