Document Description
The Department of Toxic Substances Control (DTSC) approves the class 1* permit modification for modifications to the Hazardous Waste Facility Permit Special Conditions language, specifically Special condition No. 1 (Part V) of the Permit and Special Condition No. 29 (Part V) of the Permit. On June 30, 2022, DTSC issued Hazardous Waste Facility Permit (Permit) for Lighting Resources, LLC (LRL) facility located at 805 East Francis Street, Ontario, California 91761. On May 1, 2023, LRL filed a petition for review of DTSC's permit decision with the DTSC Board of Environmental Safety (BES). As a result of the appeal and subsequent BES hearing, the BES and LRL agreed on a Joint Stipulation to modify Special Conditions related to the Permit further described in the Project Activities section below. DTSC issued the first Series A Standardized Hazardous Waste Facility Permit to LRL in 1996 and renewed the authorization by issuing a renewal permit in 2007. The permit was renewed again in 2022. The permitted storage and treatment activities involve the management of offsite generated hazardous waste [spent fluorescent lamps, High Intensity Discharge (HID) lamps, other spent mercury-containing lamps, mercury-containing instruments (e.g. manometers), and intact Polychlorinated biphenyls (PCB)-containing lighting ballasts]. Special Condition No. 1 (Part V) of the Permit will be modified to read as follows: "The Permittee shall not make any changes to the facility that require a permit modification, as set forth in Sections 66270.42 and 66270.42.5 of Title 22 of the California Code of Regulations, prior to (I) notifying DTSC, (2) processing a permit modification with DTSC, and (3) if required by the aforementioned regulations, receiving DTSC's approval of the permit modification.“ Special Condition No. 29 (Part V) of the Permit will be modified to read as follows: "The Permittee shall take reasonable efforts to notify truck drivers transporting universal waste or hazardous waste to or from the Facility that the preferred route is to avoid transportation along the section of Francis St. between Euclid Ave. and Campus Ave. past Sultana Elementary School." This modification to the Special Conditions language is being made in accordance with the Joint Stipulation between LRL and the BES, dated January 15, 2024.

The approval of the permit modification in accordance with the Joint Stipulation between LRL and the BES is consistent with the actions taken by a regulatory agency, to assure the maintenance, restoration, enhancement, or protection of the environment by properly receiving, storing, and consolidating hazardous waste.
