Reasons for Exemption
The State CEQA Guidelines provide a series of Statutory Exemptions for actions that have been deemed by the State Legislature to be exempt from the California Environmental Quality Act (CEQA). The proposed installation of an approximate 0.4-acre roadway within the Airport Operations Area at the SBIA within disturbed public rights-of-way has been determined to qualify for a Statutory Exemption under Paragraph 21080.21 of the CEQA the statute and the State CEQA Guidelines, Section 15282(k). Statutory Exemption 21080.21 exempts “The activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.” This proposed project has been determined to not fall under the jurisdiction of CEQA and the State CEQA Guidelines because these activities fall within the scope of the criteria listed in Section 21080.21. Therefore, this action qualifies with the requirements for a Statutory Exemption in compliance with Section 21080.21 of the CEQA Statute.
