Reasons for Exemption
The proposed project is exempt from the California Environmental Quality Act (CEQA) pursuant to the statutory exemption for restriping streets, which is set forth in CEQA Guidelines Section 15282 (j) and Public Resource Code, Section 21080.19, which exempts projects for restriping of streets to relieve traffic congestion. The purpose of the project is to restripe the southbound lane on Rancho Parkway at the intersection of Lake Forest Drive to create an eight-foot-wide de-facto right turn lane to help relieve traffic congestion. Furthermore, separate, and independent from statutory exemption, the proposed project is exempt from CEQA pursuant to section 15301 (c), which exempts projects which involve negligible or no expansion of existing use including existing highways and streets, sidewalks, bicycle and pedestrian trails, and similar facilities. The proposed project involves restriping the existing street to create a de-facto right turn lane at the intersection. The restriping of the lanes would involve negligible expansion of the street. The purpose of the project is to relieve congestion not to increase capacity. The City has determined that none of the exceptions to the categorical exemptions in the State CEQA Guidelines, section 15300.2 apply. Specifically, the proposed project is not located in a particularly sensitive environment. The improvements will be installed on existing right-of-way in urbanized/developed areas. Rancho Parkway and Lake Forest Drive are not officially designated state scenic highways. Thus, the proposed project would not have an impact in this regard. Similarly, the roadway is not located on a site designated pursuant to Government Code Section 65962.5. Finally, the proposed project does not involve any improvements, modifications, or other changes to an historical resource. Therefore, none of the circumstances in Title 14, California Code of Regulations, section 15300.2 applies. Thus the Class1 categorical exemption outlined above remains applicable to the proposed project.
