Reasons for Exemption
The City of San Diego conducted an environmental review that determined the project would not have the potential for causing a significant effect on the environment pursuant to CEQA Guidelines Section 15302 (Replacement or Reconstruction) which exempts the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced; Section 15303(e) (New Construction or Conversion of small Structures) which exempts the construction and location of limited numbers of new, small facilities or structures Including accessory (appurtenant) structures such as garages, carports, patios, swimming pools, and fences; and Section 15304 (Minor Alterations to Land) which consist of minor public or private alterations in the condition of land, water, and/or vegetation which do not Involve removal of healthy, mature, scenic trees except for forestry or agricultural purposes. The project Is also exempt from CEOA pursuant to CEOA Guidelines Section 15333 (Small Habitat Restoration Projects) which consists of projects not to exceed five acres In size to assure the maintenance, restoration, enhancement, or protection of habitat for fish, plants, or wildlife provided that: 1) there would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to Section 15065; 2) there are no hazardous materials at or around the project site that may be disturbed or removed; and 3) the project will not result In Impacts that are significant when viewed In connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects. The exceptions listed In CEQA Guidelines Section 15300.2 would not apply In that no cumulative Impacts were identified, no significant effects on the environment were identified, the project Is not adjacent to a scenic highway, no historical resources would be affected by the action, and the project was not Identified on a list of hazardous waste sites pursuant to Section 65962.5 of the Government Code.
