Reasons for Exemption
Pursuant to Section 21080.17 of the California Public Resources Code (PRC), the adoption of the ordinance is statutorily exempt from CEQA. Under PRC Section 21080.17, CEQA does not apply to the adoption of an ordinance by a city to implement the provisions of California Government Code Section 65852.2 (and 65852.22). The ordinance implements Government Codes Sections 65852.2 and 65852.22 within the City of Industry in a manner that is consistent with the requirements of state law. As such, the adoption of the ordinance is exempt from CEQA. Additionally, the ordinance implements a regulation change and has no possibility of having a significant effect on the environment. The ordinance does not contemplate any specific project requiring discretionary review. Any future City project that requires discretionary review will be analyzed at the appropriate time in accordance with any applicable CEQA requirements.
