Reasons for Exemption
This project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Sections: 15303. New construction of buildings under 10,000 square feet in floor areas in an urbanized area; and Section 15332. Infill Development Projects. The project meets the requirements of Class 32 as a. Is in compliance with the General Plan and Zoning Ordinance because the project is consistent with the General Retail (G-R) land use category and applicable General Plan policies that encourage the revitalization of local serving neighborhood shopping center with new businesses. b. The restaurant will be developed on a 0.86-acre parcel within city limits which is less than five acres; c. Has no value as habitat for endangered plant or animal species because the site has been completely paved and developed. d. The traffic generated by this project will not impact the site as it is less than significant as indicated in the Traffic and Parking Demand Study, dated January 19, 2024 and prepared by Hexagon Transportation Consultants (Attachment 5). • A vehicle mile traveled (VMT) study was required as the project is not considered a local serving restaurant. The VMT analysis concluded the project’s VMT is less than significant as the project would be located in an existing shopping center, replace an existing use, and not increase square footage; less than 30,000 square feet, not include a drive-through and be located considerably farther from the I-680 freeway access than the existing North Main CFA location; and reduce demand at the existing CFA restaurant. •The project will not result in excessive noise impacts for neighboring uses as the restaurant would be incorporated into an already-established commercial shopping center and would meet all applicable development standards including those related to setbacks, circulation, site planning and layout. •The restaurant odors will be controlled as indicated in the order control plan that states the chicken is cooked in a pressure cooker and top industry mechanical hood systems have capture jet technology which removes 95% of the grease particulates to keep the air clean. The odor of Chick Fil A food will not exist outside the store nor around the neighborhood. e. The site is currently served by all utilities including gas, electricity, sewer, water, storm drain, and communications.
