Reasons for Exemption
The Project is exempt under CEQA Guidelines section 15301 and 15061(b)(3) and finds the Agreement is categorically exempt and will not have a significant effect on the environment and is therefore exempt from the provisions of CEQA pursuant to Title 14 of the California Code of Regulation ("CEQA Guidelines) Section 15301 and 15061(b)(3). KTWD finds that the Agreement is exempt under the Class 1 exemption pursuant to Section 15301 because it constitutes a continued use of existing facilities, with no expansion of use and is undertaken pursuant to the terms of KTWD's and Reclamation's existing water supply contracts. The Agreement is a water management operation using only existing facilities and existing water supplies, and will not support new development or a change in land use. The Agreement does not establish a new permanent source of water supply. For these reasons it can also be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, and the Agreement is thus exempt under Section 15061(b)(3).
