Reasons for Exemption
The Project is exempt under CEQA Guidelines section 15301 and 15061(b)(3) and finds the Agreement will not have a significant effect on the environment and is therefore exempt from the provisions of CEQA pursuant to Title 14 of the California Code of Regulation ("CEQA Guidelines") Section 15301 and 15061(b)(3). KTWD finds that the Agreement is exempt under the Class 1 exemption pursuant to Section 15301 because it constitutes a continued use of existing water conveyance facilities, with no expansion of use. The Agreement uses only existing facilities and existing water supplies, and will not support new development or a change in land use. The Agreement does not establish a new permanent source of water supply. For these reasons it can also be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, and the Agreement is thus exempt under Section 15061(b)(3).
