Document Description
The Department of Pesticide Regulation (DPR) is initiating a reevaluation of neonicotinoid products containing the active ingredients acetamiprid, clothianidin, dinotefuran, imidacloprid, and thiamethoxam intended for use on nonproduction outdoor ornamental plants, trees, or turf, as a result of the California Legislature recently adopting Food and Agricultural Code section 12838(c), which requires DPR to initiate this particular reevaluation by July 1, 2024. During the reevaluation, DPR will determine if additional restrictions on use are necessary.

DPR's initiation of the reevaluation of neonicotinoid products containing the active ingredients acetamiprid, clothianidin, dinotefuran, imidacloprid, and thiamethoxam, intended for use on nonproduction outdoor ornamental plants, trees, or turf, is a ministerial product exempt from the requirements of the California Environmental Quality Act (CEQA). The California Legislature recently adopted Food and Agricultural Code section 12838(c) which mandates DPR to initiate this particular reevaluation by July 1, 2024. The law dictates a specific action by DPR and DPR lacks the discretion to deny the project (not initiate the reevaluation) or limit the scope (active ingredients and types of products). As a result, this decision to initiate this reevaluation is a ministerial project exempt from CEQA.
