Document Description
Eugene Lam has submitted a Minor Exception application, requesting to construct a 334 square foot first-floor addition and 547 second-floor addition to a legal nonconforming 1,296 square foot single-family dwelling. The square footage of the single-family dwelling would total 2,177 square feet. In addition, the applicant has proposed a 1,050 square-foot attached accessory dwelling unit that is not included in the Minor Exception application. The project site is located at 3362 Kelburn Avenue (APN: 5287-022-043) and is in the Light Multiple Residential (R-2) zone. The existing single-family dwelling unit is nonconforming due to the existing 3’-11 7/8” side yard setback (minimum 10’-0” side yard required) along the north property line.

Section 15303 of the California Environmental Quality Act guidelines exempts projects consisting of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. Accordingly, Minor Exception 23-06 is classified as a Class 3 Categorical Exemption, pursuant to Section 15303 of California Environmental Quality Act guidelines.
