Reasons for Exemption
Text amendments to municipal codes are exempt from the California Environmental Quality Act (CEQA), pursuant to CEQA Guidelines Section 15061 (b)(3), which states that CEQA applies only to projects that have the potential for causing a significant effect on the environment. As a Municipal Code text amendment, there is no possibility that the proposed action may result in a significant effect on the environment. Therefore, the text amendment to the City’s Municipal Code is exempt from further review under CEQA. Furthermore, pursuant to CEQA Guidelines Section 15273, the establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, and other charges by agencies are statutorily exempt.
