Reasons for Exemption
The project qualifies for a Categorical Exemption (Class Seven) pursuant to CEQA Guidelines Section 15307 (Actions by Regulatory Agencies for Protection of Natural Resources). The project consists of an update to the Building and Construction Ordinance and the Health and Sanitation Ordinance requirements to assure the maintenance, restoration, or enhancement of a natural resource where the regulatory process involves procedures for protection of the environment. The project will limit the extraction of groundwater by expanding the application of water-efficient plumbing fixture requirements, updating plumbing fixture requirements to be of higher water-use efficiency, and improving water conservation program policies. The update is based on the results of the Los Osos Water Offset Study, an audit of the water offset program based on historical consumption data and industry-supported standards. It can be seen with certainty that the project qualifies for the exemption because it reinforces a County program that promotes the maintenance, restoration, and enhancement of the Los Osos groundwater basin.
