Reasons for Exemption
The garage portion of this proposed project is Categorically Exempt (Class 3) from the provisions of the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000, et seq.) CEQA pursuant to CEQA Guidelines Section 15303, because it is limited to new construction of a small structure appurtenant to an existing single-family residence. The ADU portion of this structure is exempt from the provisions of the California Environmental Quality Act California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000, et seq.) because it must be processed ministerially per State law and is therefore not a project as defined by CEQA.
