Document Description
The proposed project includes the remodel and ±2,000-sf expansion of an existing ±3,280-sf building to allow fish and crab processing activities, for a total of ±5,280-sf building. The proposed project area is located entirely within the State (California Coastal Commission) jurisdiction. However, because the a small portion of the property includes the local (City of Crescent City) jurisdiction the State asked the applicant to submit to the City a request for a consolidated permit process. Therefore the applicant is requesting a consolidated Coastal Development Permit to be processed at the state level.

Reasons for Exemption
The subject ordinance would be exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15061 (b)(3). This section is the "common sense exemption" that states that CEQA applies only to projects that have the potential to cause a significant effect on the environment. If the Lead Agency can determine that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Under this section, the proposed CDP consolidation request fits within the general rule that CEQA only applies to projects that have the potential to cause a significant effect on the environment. In that the proposed CDP consolidation request allows the environmental review of the proposed project to be completed at the state level; and, therefore the activity is not subject to CEQA at his time.
