Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement Number EPIMS-MON-43565-R4 pursuant to Fish and Game Code section 1602 for the Project. This Agreement describes activities that will address and resolve a Notice of Violation issued by CDFW on June 14, 2022 (Violation No. 1600-2022-0821-R4), in response to the large-scale grading and construction of a Multi-Benefit Community Trail (MBCT) within the floodplain of the Carmel River. Project activities include trail retrofit, construction, and retirement in addition to revegetation activities.

Reasons for Exemption
The Project will consist of actions related to 1) the reconstruction of existing facilities, where the new structure will be located on the same site as the structure replaced (trail retrofit) 2) construction of a limited number of small facilities (trail construction) and 3) minor alterations in the condition of land and vegetation which do not involve the removal of healthy, mature, scenic trees (trail retirement, decomposed granite removal, and revegetation activities). The Project will not have significant environmental impacts if it is completed under the protective measures of Streambed Alteration Agreement No. EPIMS-MON-43565-R4.
