Reasons for Exemption
The project is exempt from the California Environmental Quality Act under Sections 15304 and 15303 of the CEQA Guidelines. The road widening is within the scope of the Class 4 categorical exemption for "minor public or private alterations in the condition of land, water and/or vegetation which do not involve the removal of healthy, mature scenic trees..." The project requires the removal of 3 heritage-sized trees but according to the arborist report, they are only in "fair" health with "fair" form/structure, and the City has determined they are not healthy, mature, and scenic. A retaining wall that is part of the project also qualifies for the Class 3 categorial exemption applicable to the construction of new, small structures.
