Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Class 2
Reasons for Exemption
Section 15302 Replacement or Reconstruction (Class 2): The Class 2 Categorical Exemption consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The project involves the removal and replacement of the anode ground bed; the anode ground bed will have the same purpose and capacity as the structure replaced. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines Section 15302 (Replacement or Reconstruction); therefore the Project is exempt from CEQA and no further environmental review is required.
