Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Class 3 and Class 4, CEQA California Code of Regulations, Title 14, Section 15303, 15304
Reasons for Exemption
The Board has determined the project is exempt from CEQA under the Class 3, New Construction or Conversion of Small Structures categorical exemption (CEQA California Code of Regulations (CCR), Title 14, Section 15303) because the proposed activity consists of the installation of a private boat dock, an aluminum gangway supported by a concrete landing, and a debris diverter. The project is also exempt under the Class 4, Minor Alterations to Land categorical exemption (CEQA CCR, Title 14, Section 15304) because the proposed activity consists of the construction of the concrete landing pad on the edge of the levee crown and does not involve the removal healthy, mature, scenic trees. Further, none of the exceptions to the exemption in CEQA CCR, Title 14, Section 15300.2 apply. The Central Valley Flood Protection Board's (Board’s) administrative record related to the encroachment permit is available for public review at the Board's office. Please note, the signed NOE is not attached. If you would like to request a signed copy of the NOE, please contact Board staff at: questions@cvflood.ca.gov.
