Document Description
On October 24, 2023, the County of Los Angeles (County) Board of Supervisors (Board) approved an ordinance granting a proprietary industrial gas pipeline franchise to Air Products and Chemicals, Inc., a Delaware corporation (Franchisee), to operate and maintain its industrial gas pipeline system in the same manner as that system existed and was operated at the time of the operative date of this ordinance, for a period of five years, beginning of November 23, 2023 and expiring on November 22, 2028. Adoption of the ordinance allows Franchisee to continue to operate and maintain its pipes and pipelines to provide continuous proprietary industrial gas services to unincorporated County areas and obligates Franchisee to comply with the terms of the franchise.

Reasons for Exemption
It can be seen with certainly Oat there is no possibility that adoption of the ordinance may have a significant effect on the environment pursuant to section 15061, subdivision (b)(3), of the State CEQA Guidelines. The ordinance is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Approval of the grant of franchise to allow Franchisee to operate and maintain its pipes and pipelines existing and in the same manner as of the operative date of this ordinance is exempt under this common-sense exemption because it does net approve any general or specific activity not currently in operation. The recommended actions to allow the continued operation and maintenance Franchisee’s existing industrial gas pipeline system are also within a class of projects that have been determined not to have a significant effect on the environment in that it meets the criteria set forth in section 15301 of the State CEQA Guidelines. In addition, based on the record, the recommended actions wilt comply with all applicable regulations; they are not in a sensitive environment; and there are no cumulative impacts, unusual circumstances, damage to scenic highways, or listing on hazardous waste site lists compiled pursuant to Government Code, section 65962.5; or indications that they may cause a substantial adverse change in the significance of a historical resource that would make the exemption inapplicable.
