Reasons for Exemption
Class 3 consists of construction and location of limited numbers of new, small facilities or structures, including fences. The Sacramento County Zoning Code states solid fences in the front yard setback shall be limited to three feet in height (Section 5.2.5.B.1.a.(i) of the Zoning Code), or up to seven feet, with issuance of a Minor Use Permit subject to the General Findings described in Section 6.4.2.C.2 of the Zoning Code. In addition, the approving authority shall determine there is a preponderance of solid fencing over three feet in the neighborhood and/or the fence is located along an arterial or thoroughfare. The project consists of the installation of a 6-foot concrete masonry wall, fence, and motorized iron gates on a developed site. Therefore, the project is exempt from the provisions of CEQA.
