Reasons for Exemption
The use of the CEQA exemptions is also supported in part, by the determination of Coastal Commission Staff, of a de minimis finding as part of a ‘CEQA equivalent program’ (Statutory exemption 15251 (c). The project is exempt from CEQA under 15301-existing facility with no expansion of use, 15302-reconstruction, as the recreational park facility has the same purpose and capacity as what is replaced, and 15303-new construction of the facility as the project only includes minor modifications, as part of the overall Beach Front Park. Grading activities would fall under 15304 (a). The project also meets the criteria of Section 15332 for the following reasons: 1) the project is consistent with the Coastal Open Space Zone; 2) the project site is located in City limits on a project site that is less than 5 acres (~0.5 acres); 3) the project site is a developed park with turf that does not contain habitat for rare, threatened, or endangered species; 4) the project proposes a small bike facility that does not have the potential for significant impacts related to traffic, noise, air quality, or water quality; and 5) the site can be served by all required utilities and public services. None of the exceptions to the use of categorical exemptions per CEQA Guidelines 15300.2 would apply.
