Reasons for Exemption
The construction of a new fence is exempt pursuant to Class 3 (CEQA Guideline Section 15303), which allows for accessory structures including fences. Additionally, the proposed sale of real property and grant of a public utility easement are exempt from CEQA pursuant to CEQA Guidelines Section 15061 (b)(3) by virtue of the general rule that CEQA applies only to projects that have potential to cause a significant effect on the environment. Based on review of this sale of property and grant of a public utility easement, the Agency has determined that it will not have a significant effect on the environment.
