The California Department of Fish and Wildlife has executed Streambed Alteration Agreement number EPIMS-SIS-41794-R1, pursuant to Section 1602 of the Fish and Game Code to Karra Medeiros.
The project is limited to activities associated with 1) the diversion of water from Boles Creek at a single point of diversion, and 2) maintenance of the gravity-fed diversion and flume. The Permittee diverts water from Boles Creek pursuant to Decree #7035 of the Superior Court of the State of California (Decree) in and for the County of Siskiyou judgement for Shasta River, and/or riparian claimed water right to the State Water Resources Control Board (SWRCB) Division of Water Rights. Maintenance of the diversion includes the annual placement and removal of the headgate with screen and pipe into the channel of Boles Creek, adjusting headgate, and cleaning screen. It may include creation of temporary dam with stacking rocks and/or tarps, removal of vegetation in the vicinity of the diversion, and adjustments to the downstream flume across the creek. Hand tools will be used as needed to accomplish tasks. All removed material will be hauled offsite. Vegetation on the banks shall be minimally disturbed as needed to access the wetted channel. Any work requiring manipulation of the bed, bank, or channel and/or use of heavy equipment will be done with a work plan approved, in writing, by CDFW prior to work commencing.
In addition, Permittee notified for three adjudicated water rights on unnamed tributaries of Boles Creek at two separate points of diversion. An agreement for Diversion 56, 57, and/or 58 is not necessary at this time.
