Document Description
Severe winter storms related to a series of atmospheric river systems that brought substantial precipitation and river flooding throughout Northern California between December 27, 2022 and January 1, 2023. Governor Newsome proclaimed this event, including damage incurred in El Dorado County, as a State of Emergency on January 4, 2023, and directed the California Office of Emergency Services to provide assistance to local governments, if appropriate, under the authority of the California Disaster Assistance Act, Government Code section 8680 et seq., and California Code of Regulations, Title 19, section 2900 et seq.
Governor Newsome requested that President Biden declare this event a federal emergency (Section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. §§5121-5207 (the “Stafford Act”), as implemented by 44 C.F.R. §206.35on January 8, 2023). President Biden approved the requested federal emergency declaration on January 9, 2023.
These storms caused the South Fork of the American River to rise to extreme flood stage, depositing cobble and rock throughout the HLP boat ramp and parking lot. The County of El Dorado removed approximately 500 cubic yards of rock from the parking lot and proposes to remove rocks from boat ramp area. This remedial action, removing approximately 35 cubic yards from the 25-foot-wide boat ramp area, is the subject of this statutory exemption.
The proposed project is statutorily exempt for potential application in disaster recovery efforts from the provisions of CEQA pursuant to State Public Resources Code Section 21080 (b)(3) and CEQA Guidelines Section 15269(a).
