Document Description
To abandon-in-place two existing 48-in diameter concrete septic tanks located 18-inch-deep. To install a new sewer line to connect to the County's sewage system. To update the existing overhead electric utility located between the ADU and the house to an underground utility. To replace the existing wood deck. This is also a "name change" permit that includes conditions that are consistent with current flood control standards and policies of the Central Valley Flood Protection Board. The permit supplements, and when in conflict, supersedes Permit No. 3095 that was issued to Irving J. and Kaye Schwartz on July 1, 1959 to construct a residence on the lot.

Reasons for Exemption
The Board has determined the project is exempt from CEQA under the Class 2 Replacement or Reconstruction categorical exemption (CEQA California Code of Regulations, Title 14, Section 15302) because the proposed activity includes replacement of the existing wood deck. The project also is exempt from CEQA under Class 3, New Construction or Conversion of Small Structures categorical exemption (CEQA California Code of Regulations, Title 14, Section 15303), because the proposed activity includes updating the existing overhead utility lines to underground utility, and installing a new sewer line to connect to the County sewage system. Further, none of the exceptions to the exemption in CEQA California Code of Regulations, Title 14, Section 15300.2 apply. Board staff has determined that an application to change the name of the permittee does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and thus, is not a “project” for purposes of the California Environmental Quality Act (Public Resources Code § 21065; CEQA California Code of Regulations, Title 14, Section 15378(a)).
