Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement EPIMS-HUM-39653-R1, pursuant to Section 1602 of the Fish and Game Code to Mr. William Rector. The project is limited to 4 encroachments. One encroachment is for water diversion from Elk Creek for domestic use. Work for the water diversion will include use and maintenance of the existing water diversion infrastructure (e.g., offset well). The other three encroachments are to remediate an unpermitted water diversion, unpermitted stream crossing and unpermitted stream bank alteration. Work for these encroachments will include some or all of the following: excavation and spoiling of material, removal of the existing culvert, rock armoring as necessary to minimize erosion, and revegetation with native riparian trees.

Reasons for Exemption
The project will permit remediation of unpermitted grading in the riparian zone of a stream, decommissioning an unpermitted water diversion, decommissioning an existing but unpermitted stream crossings, and use and maintenance of an existing water diversion, involving minor alterations to land. The authorized work is associated with resolution to a notice of violation associated with illicit cannabis cultivation activities documented on April 7, 2023.There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
