Document Description
The applicant is requesting approval of a Cannabis Oriented Business Land Use Permit (P20- 094). The Project is located at 592 West Esplanade Avenue. The 3.92-acre site includes an existing building, a portion of which will be utilized for the project (Unit 'B'). Unit 'B' is 22,145 square feet and encompasses the northeast portion of the building and has a footprint of 22,145 square feet. Approval of the project would allow the applicant tb establish Indoor Cultivation business within an existing building. In addition to the land use permit, the applicant will be required to obtain a regulatory permit, a business license, and a cannabis license from the state. The remainder of the building will be utilized for a separate cannabis cultivation project (P20- 095) which will encompass 32,945 square feet (Unit A). In addition the site also includes an existing 1,030 square foot office building in front of the 55,350 square foot building that is currently vacant and not part of the project. The Project includes the establishment of a 22,145 square foot Indoor Cultivation within Unit 'B' that includes the following: a. A 10,559 square foot area for Flower Rooms; b. A 1,805 square foot area for Dry Rooms; c. A 1,627 square foot Vegetative Room; d. A 1,354 square foot Tank Room; e. A 1,157 square foot Mother Room; f. A 569 square foot Trim Room; g. A 260 square foot Clone Room; h. 4,814 square foot total area for auxiliary services (restrooms, lobby, housekeeping, office, break room, security office, corridor, etc.). The proposed Indoor Cultivation use is situated on a single parcel located at the southeast comer of Esplanade Avenue and Juanita Street. The project site consists of an existing 55,350 square foot, one story building. Other improvements on the site include paved parking and circulation driveways; curb gutter and sidewalk, two cell towers, a 1,030 square foot office building and several landscape areas. The site also currently includes outdoor storage of materials which will be removed. The project will create two separate units (Unit A and Unit B) that will both be utilized for cannabis-oriented business. This project (P20-094) only includes Unit B. Cultivation activities will utilize 17,331 square feet of the 22,145 square foot Unit B. The remaining portions will be utilized by auxiliary uses, which include elements such as restrooms, office, break room, security office, common space, corridors, etc. There will be 15 rotating employees during the operating hours of 7:00 a.m. to 7:00 p.m. The cultivation process will include several different rooms with individual temperature controls and watering schedules. The General Plan designates the project site as Industrial, which allows for a variety of industrial and manufacturing activities. The parcel is also zoned Industrial Light (IL) which is consistent with the General Plan. The proposed Indoor Cultivation is expressly permitted in the IL zone, subject to a Commercial Cannabis Land Use Permit and Regulatory Permit. The proposed· property and project is compliant with the Cannabis Oriented Business Land Use Permit.

Reasons for Exemption
The Department of Cannabis Control (DCC) has determined that the project is a Class 1 Categorical Exemption project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. None of the exceptions to this exemption defined in Section 15300.2 apply. Additionally, DCC has determined that the project is a Class 3 Categorical Exemption project. Class 3 Exemptions consist of construction and location of limited numbers of new, small facilities or structures; and the conversion of existing small structures form one use to another where only minor modifications are made in the exterior of the structure.
