Document Description
The Kings County Community Development Agency has received one application for a Lot Line Adjustment and four applications for Site Plan Review Agricultural Land Divisions for the purpose of retaining an existing farm home and issued six building permits on undersized parcels. These applications created property less than ten acres in size that are currently restricted by Land Conservation “Williamson” Act Contracts. Pursuant to Government Code Section 51222, properties less than 10 acres in size are not considered to be able to sustain a commercial farming operation. Therefore, the Community Development Agency is initiating Notices of Partial Non-Renewal contracts on said parcels.

In addition, none of the special circumstances in CEQA Guidelines Section 15300.2 apply.

Reasons for Exemption
The proposed partial Non-Renewals are exempt from environmental review pursuant to CEQA Guidelines Section 15061(b)(3), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. In addition, none of the special circumstances in CEQA Guidelines Section 15300.2 apply.
