Reasons for Exemption
Under CPCN, D.21-03-027, the CPUC determined that the projects proposed by Arcadian Infracom2, subsidiary of Arcadian Infracom, Inc., would qualify as exempt under one or more CEQA categorical exemptions. The CPCN states that the applicable CEQA exemptions for this project may include Class 1 and 3. Class 1 includes the operation, repair, maintenance, leasing or minor alteration of existing public or private structures and facilities, with negligible or no expansion of an existing use. This includes existing facilities used to provide public utility services. 14 CCR § 15301. Class 3 includes the construction including water main, sewage, electrical, gas and other utility extensions of reasonable length to serve such construction. This includes the construction of limited numbers of new small facilities or utility extensions. 14 CCR § 15303. The project would qualify for one of these Categorical Exemptions because: 1. There is no reasonable possibility of a significant effect on the environment due to unusual circumstances; 2. There are no significant cumulative impacts from projects of the same type will result; and 3. Based on a review of existing information, the high level of disturbance and development along the alignment, and results of field surveys, the project will have no impacts on a uniquely sensitive environment. (Guidelines § 15300.2.).
