Document Description
An Administrative Development Permit for the commercial cannabis operation located at 19440 Edgett Lane, Penn Valley CA, 95945. The project is located on a rural, 11.6-acre parcel in an Agricultural zoning district. This approval is for a two-phase operation. Phase 1 will include 4,320 square feet of mixed light canopy area and 2,425 square feet of support area. The phase 1 support area will be comprised of one (1) 1 O' by 1 O' shed for agricultural chemical storage and harvest storage, one (1) 30' by 70' hoop house for immature plants and drying, and one (1) 15' by 15' outdoor processing area. The 4,320 square feet of canopy area is aggregated from the canopy within one (1) 32' by 100' hoop house and four (4) 20' by 66' hoop houses. Phase 2 will include a reconfiguration of the canopy area resulting in 4,240 square feet of mixed-light canopy aggregated from the canopy within two (2) 32' by 100' hoop houses and one (1) 32' by 95' hoop house that will be in the same area of disturbance as the hoop houses from phase 1. The support area configuration will remain the same. The residence, support area, and cultivation area will be accessed by an existing gravel driveway. The project is irrigated by water from an existing well and the residence will use a septic system for sewage disposal. Full-time tasks on site will be performed by 1 full-time employee and the owner/applicant. No new disturbance is proposed because the cannabis cultivation and support areas will be located on land that was previously developed as a horse arena and as an animal enclosure. Based on satellite imagery, the horse arena has existing since before June 2007. The development of the animal enclosure occurred between 2018 and 2019 but did not involve the removal of trees as verified by satellite imagery. There will be no development within the setback buffers of any aquatic resource, within a floodplain, or on slopes steeper than 30%. No noise producing equipment such as HV AC systems, generators, or fans will be used in the operation. Lights will be used in the hoop houses for cultivation and blackout tarps will be used to prevent light pollution. There will be no exterior lighting. A Notice of Applicability was issued by the Central Valley Regional Water Quality Control Board for the cannabis cultivation operation which contains requirements that the applicant must meet to ensure water quality is not impaired. An annual cultivation license from the California Department of Cannabis Control shall be obtained prior to the County Annual Cannabis Permit being issued. This project includes a setback easement because the proposed location of the cannabis operation on the Martin property (parcel 001-330-043) would encroach 40 feet into the required cannabis setbacks from the northern property line. The easement extends the cannabis setback into Olson property (parcel 001-850-002) to allow the cannabis operation on the Martin property (Parcel 001-330-043) to meet the required setbacks. This easement will provide for the equivalent of the required 100-foot cannabis setback on the Grantee's parcel and for the maintenance of adequate reduction of un-irrigated flammable vegetation within said Easement, being more particularly described and shown in the exhibit A and B, which are attached and subject to modification prior to recordation as required by the county surveyor.

The project is consistent with the local jurisdiction community plan and/or zoning designations. CEQA mandates that project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
