Reasons for Exemption
The proposed purchase of the Property will not have an impact on the environment and is therefore exempt from CEQA review pursuant to CEQA Guidelines Section 15061(b)(3), the “common sense” exemption, which states that, where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is exempt from CEQA. The proposed action would only transfer ownership of the Property and does not involve changes to the use of the Property. The City has been leasing the Property as a tenant and now will become the owner. The proposed purchase of the Property is also exempt from CEQA under CEQA Guidelines Section 15301 as the operation of an existing public structure involving negligible or no expansion of existing or former use. The proposed action transfers ownership of the Property which the City has been leasing as a tenant.
