Reasons for Exemption
The Project is exempt from CEQA under State CEQA Guidelines section 15301 (the Class 1 exemption), which applies to the minor alteration of facilities, where the alteration involves negligible or no expansion of existing or former use. The proposed Project falls squarely within the Class 1 exemption, as the removal or covering in place of the Alvin Cleveland Park Features constitutes a minor alteration to Los Angeles Pierce College, an existing educational facility, and the Project would not involve any expansion of Pierce College's existing or former use.
Moreover, none of the exceptions to the Class 1 exemption set forth in State CEQA Guidelines Section 15300.2 apply. Notably, the District found that the Project does not involve any unusual circumstances, that the Alvin Cleveland Park Features do not qualify as a historic resource, and that the Project would not result in a substantial adverse change in the significance of any historical resource.
The Project is also exempt from CEQA under State CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that there is no possibility that the relocation or covering in place of the Alvin Cleveland Park Features may have a significant effect on the environment.
