The Kings County CMAQ Seal FY 22/23 project is exempt from CEQA review pursuant to Section 1530l(c) of the Guidelines for California Environmental Quality Act (CEQA Guidelines). This section states that a project is exempt from CEQA if the activity consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use. The key consideration being negligible or no expansion of use. This project involves repairing existing failed bituminious roadway bases and sealing the roadways as a PM control measure. The roadways will not be expanded. The construction will be negligible.
