Document Description
On March 1, 2023, Governor Gavin Newsom declared a State of Emergency for many counties throughout the State of California due to severe winter storms that brought heavy rain, thunderstorms, and strong winds that caused devastating floods. Bartlett Park is located at 28801 Worth Dr. Porterville, CA 93257. The Park is positioned just below Schafer Dam and is intended to absorb the overflow from the dam spillway. On March 10, 2023, Lake Success met its capacity, and water began flowing through the park at an estimated rate of 6,500 cubic feet of water per second (CFS) as the dam released 5,200 CFS. The storms caused detrimental effects to the Park, damaging many areas including but not limited to electrical, structural, landscaping, ponds playground equipment, roads, and irrigation.
The expected repairs include replacing damaged electrical equipment, dredging the irrigation pond, interior road repair, assessing and repairing the play equipment, irrigation repair, grading of the new drainage channel between the ponds, repairing the berm of pond three, replacing irrigation pumps, removal of sediment and rocks, and general clean-up of debris. Most of these repairs are critical to not only the operation of the park but to keeping the established trees alive.

Reasons for Exemption
This action is consistent with Title 14 of the California Code of Regulations, § 15269 sets forth emergency projects that are exempt from the requirements of the California Environmental Quality Act ("CEQA") The installation of the new, replacement well at the Park falls within the scope of CCR § 15269(c) as it is a specific action "necessary to prevent or mitigate an emergency." Public Resource Code §21080(b)(4) also exempts the installation of the new well from CEQA as "necessary to prevent or mitigate an emergency." Therefore, the application of CEQA Section 15269 is applicable and appropriate for this project.
