Reasons for Exemption
CVWD’s approval and adoption of the Replacement Project is categorically exempt from CEQA under the Class 2 exemption set forth in State CEQA Guidelines section 15302. The Class 2 exemption applies to, among other things, “replace or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.” (State CEQA Guidelines, § 15302.) Here, the Replacement Project falls within the Class 2 exemption as the proposed project entails the replacement of an existing utility system/facility and involves negligible or no expansion of an existing use. For the foregoing reasons, the Replacement Project is categorically exempt from CEQA.
